It is known to all that female employees belong to a special group among employees, and hence the law provides a lot of special care on them. The provisions on the protection of female employees may be found in the Law on Protection of Women’s Rights and Interests (2005), Law on Employment Promotion (2007), Employment Contract Law (2008), Social Insurance Law (2011), Law on Population and Family Planning (2002) and other national laws and the matching provisions, in particular, the latest Special Provisions on Labor Protection of Female Employees (hereinafter referred to as the “Special Provisions”) issued by the State Council on April 28, 2012 and implemented as of the day. These laws, rules and regulations constitute the special legal system on female employees of the state systematically and meanwhile each and every law, rule or regulation focuses on different aspects.
The system at least includes the following features:
1. Covering many areas with massive provisions: the contents are numerous and jumbled including all aspects of management of female employees;
2. Repetition overlaps: contents of different laws, rules and regulations repeat and overlap each other; and
3. Conflicts between standards: there would always be different provisions between different areas, between the state and the local areas, between the new and old provisions, etc.
Therefore, it is not easy for the managers of enterprises to clearly understand and grasp the system and integrate it with the practice of female employee management, however, it is their inalienable duty.
